According to the complaint, Smith is 5'8" tall and weighs 132.5 pounds (60 kg), down from 145 pounds (66 kg) when she was recruited for employment in 2008.

 

I wouldn't call her fat I mean 5'8" and just under 9 & 1/2 stone

Being as Hooters have been running for decades in the most litigation-happy country in the world without being on the wrong end of any previous substantial lawsuits in this regard, I'd suggest they're probably quite safe.
