I think it does include bank holidays but it's at the discretion of the employer as to whether TOIL is included. My other half works shifts, gets a shift enhancement because he has to work BHs if they fall within his shift. For example he is working all over Easter and won't get time off in lieu for that. However, I used to get x days holiday PLUS BHs.
