I'm slightly excited that that a bit do Southampton will be spending the day in Kirkwall tomorrow . The queen elizabeth will be making only her second visit to Orkney . It will bring a touch of home tomorrow . I slightly excited as I'm hoping to get on board tomorrow . Will take some photos . We have the queen Victoria here in 2 years as well

There's very few scouse un pc words in the list . Or is it okay to have local dialect words . I'm suprised to see the w. o .g word I hadn't seen or heard that for decades I see in another article re scouse lingo . Thats really Sad. My mate will be gutted he a true coventry fan. He owes me a fortune . We made a bet years ago that if saints finished above coventry he would give me a fiver each season and vice versa. I have only ever given him a fiver once, We have a mounted a fiver as a trophy . I have had it for the last 13 yeaRS, Semms I will keep it for a good few years to come

Saintfully . Do your home work . I have an HR degree and I studied at Leicester university for my masters in employment law and industrial relations . Some of my peer groupware lawyers who had LLB while the other Hals of then group had hr degrees . Had I have had an LLB then I would am LLM after my name instead of MA . There are exactly the same same course same dissertation criteria just a different silk you wear at graduation

I love employment law issues . I'm glad I chose to study this and got an MA in employment law . Case law in recent times has added more questions than answers whether it was the springer case the Gomez case . perada or even the larner case. These are all related to holiday entitlements for one reason or another . I was speaking to an eminent employment lawyer a couple of months back . One Toni maclinden . She has some interesting views on sickness holidays etc and the debate of 20 or 28 days . Suffice to say that clarification is being sought and hopefully the confusion that currently exists on what an employee is entitled to should become clearer in respect of long term sickness absence

Not strictly true Barry . . 28 days is the norm but it the interpretation of European law that needs to be clarified . It's being questioned on a couple of fronts . One area being looked at is the accrual of holiday if on long term sick for a year plus. Holidays were given to allow workers to rest from work . If they are on long term sick they are not at work so should they be given holidays? Also there is a decision awaited on the 20 day or 28 day ruling re accrued holiday entitlements . It is a very expensive cost to companies.

Pap do you your homework . Zero hours contracts will accrue holiday pay and probably sick pay . An employee who works will accrue holiday from day one whether on a casual contract or zero or what ever variation exists . It will be prorate for the hours worked. They will be entitled to 28 days per year and possibly 20 once clarification has been sought following two cases in Europe the working time regs state 4 weeks holiday but this may be 20 if the normal working week is just five days . But some expert suggest it should be based on a 7 day week .

AS I have a bit more time I will try to explain zero hours contracts, As I said earlier the key area to focus on is the nature and content of the contract in place between employee and employer Zero hours and Casual Contracts are very similar the employee undertakes to be available for work at the employer's request, but will only be paid only for work done. From this type of contract the employee gains continuity of employment and can claim unfair dismissal after one year (or two years if his or her employment begins on or after 6 April 2012) They could also be entitled to any redundancy pay after two years service based on hours they have been employed as Casual contractors are slightly different and are engaged purely on an ad hoc basis, and there is no continuing employment relationship between engagements. (No Mutual obligation to provide or accept work Thus, most casuals do not gain continuity of employment. Back to the contarctv the employer should make it clear if there is a continuing employment relationship between periods of actual work, or whether there is a series of separate contracts In respect of casual workers. if they are to be used continually for 6 or 8 weeks . dependant on the employer, then an employer should be issuing a temporary contract if the employee is covering for something like long term sickness etc, This will allow for continuity of service etc be accrued , There have been a number of abuses using casual contracts mainly in the areas such as care or cleaning in private companies. Sorry Bridge for not explaining more clearly in my earlier post . each contract will be different and it would be wrong for the media to assume that ZERO contracts are identical up and down the country . They are not The basic clause in a zero hours contract will normal have the fol;lowing wording The organisation's need for individuals to perform work varies from time to time. You agree to be available for work, should the organisation decide to offer you work. However, the organisation has no obligation to offer you work at any time, and you are not entitled to a minimum number of hours of work per day, week or year. If X does offer you work, (the “assignment”), you are required to accept and complete it to the organisation's satisfaction. Where the organisation offers an assignment to you, it does not give rise to a presumption that it will offer you further assignments. Your hours of work for each assignment will be determined by the organisation in advance of the assignment and set out in a written schedule. While the key for casual is as follows, and the following is the one I devised a few years ago I am pleased to confirm the offer of casual work as and when required. Should you accept this offer, you must understand that if appropriate work is available it may be offered to you, although xxx is under no obligation to do so, equally you are under no obligation to accept any offer of work. 1. Type of Work You will provide your services as . You will not be an employee of XXXXX and at no time will there be any mutuality of obligation between you and the XXXX You may be offered work by the XXXXl at its discretion, but there will be no obligation on the XXXX to offer work or for you to accept it on any particular occasion.

Sorry this is a non story. thypical guardian reporter trying to drive a wedge between the employers , the workers and the unions or whoever These types of contracts are used up and down the country and used a lot in the public sector . So they can cover sickmess etc at short notice in places like school support staff, and social services. Normally referred to as casual or relief contracts. The are based on the concept of mutal obligation. I.e there is no mutial obligation to offer some one work but where work is offered the employee is not obliged to accept the work on offer.So it benefits lots ofpeople even thse who are in partime work etc. It is not an explitation. They may well be seasonal staff. Its the wording in the contract that is important.

I have calmed down now . but society can be unfair. As I said I disagree with the vans the are being driven around parts of the UK just a quick point on Buctooms insensitive post "However she has managed to swing a two year stay at a Church Of Scotland hostel" If you knew anything about the Church of Scotland . This person was married to a minister and they lived in a manse. However when the said Minister took up with a widowed woman as well as physically abusing his he broke the marriage. It was not the Minister who had to move out as the church does not allow that . No it was his wife . She was Homeless through no fault of her own , just a devoted mininsters wife. She went cap in hand and the church found her some accommodation which she pays rent on. Fortunatelly she is a proud person and had no savings and is as honest and genuine as they come. She was given a small amount money by her ex. which she used to get her self together . pay the rent and feed her children . She has and never will look for state handouts , that is not in her nature. and she very much has the same ideology as pap etc . Oh Norway, very witty , but she was that close to camping out in Union Street . So please buctoom before you come out with those comments do your research. Do some research and look up the case of Rev Helen Percy . It just confirms how vindictive the male dominated Church of Scotland is. Her book, Scandalous Immoral and Improper, is a real eye opener and is an excellent read, PS As for Alpines OP. I think it is wrong that an advert like that is being used as it does not help integration in our country. Those who are abusing the system and are here illegally will continue to do just that meanwhile. the thousands of folk who are genuinely here will be wrongly targeted by the extreme right wing idiots and that doesnt bode well for an integrated society

I disagree with the vans that are being used to promote a negative message about immigration . There are thousands who genuinely bring something worthwhile to the country and I support those folk as well as those who flee tyranny and oppression in their country of origin . There are some destitute folk in the uk and for what ever the reason fall out side of the state support system . That is was I'm so incensed about . The person I refer to was discarded by the church if Scotland . Read the story of Helen peacey . Who was raped by an elder of the church . Maybe this is the wrong thread to raise these issues and I did have a few beers lastnight apologies

I will make it quite clear she no longer has the 20k but used that to put her through a nursing qualification . To pay for the course to pay for the rent to support her two children and pay for their day to day needs without any aid from the state . Apologies if I didn't explain myself clearly . She as done that on just under 7 k for each of the past three years . You holier than thou guys try living on 7 k a year without access to state benefits . Quatada and now his family are still receiving state benefits . So where is the fairness in the state system , I partly blame the Church of Scotland as well as the state benifits system . So please read my posts in the context of the system and the original posters thread . Please do not distort the facts I ready to poor score scorn on the state system . It's situations like this that make me more labour than Tory . I believe in a fair system that supports people for the right reason . And this lady is evidence is one of thousands in the uk who fall foul of the state system and actually genuinely need support and assistance . She is too proud to make an issue of her dire needs . She is currently in a Church of Scotland refuge house but has to move out in October . As she was only given temporary accommodation for two years. He ex minister went off with another parishioner and left her with nothing . . The point I am making is the state seems to give priority to folk from abroad . Yet when she has asked for help from the state she is declined and is too proud to force the issue . At least she is too proud to ask for help . . My point is sometimes the housing problem is easilybabused . Look at the amount of abused women who are in emergency accommodation . And let's not forget the amount of ex servicemen living rough . It's not about racism but the complete opposite .
