  3. pes, I think you have worked out by now that we all pretty much want the pst to win, but as you say above, it is all down to best deal fro the creditors. With Chanrai being the largest one and offering to swap 13 million of debt for Equity, that's a lot of sofa's they will need to check the back of, to match that. Additionally, the original trust bid, wanted to offer the players under the compromise agreements 2 million of the 8.8 agreed, now apparently they have agreed to match it - Where did the other 6 million quid suddenly come from? It's been explained by the people from the trust (Without confimation) that they have adjusted the budgets to make up the short fall. So does that mean that this "Best deal for the creditors" "Community driven" pst orginally wanted to stiff the creditors AGAIN, to allow more funds to buy players and go towards player wages?????????????......... I think I've heard of a club that has done that a few times before.

The pst cited some passage from admin law that highlighted there was additional criteria based on which bid was most likely to succeed and honour agreed payments, as well as whta was in the long term interests of the company, but it was all pretty woolly. The problem Birchy has is the additional element of risk and assumption the pst bid holds..... and that is before Portpin go to court over the valuation for fratton - But then if that happened - It would mean more fees for pkf

  13. The golden share is issued by a boys club. The law has no say on what terms they wish to apply, so there is no chance of them being taken to court. I suspect though (Happy to be proven wrong) that the conversion of all debt to equity, now makes it impossible for Birch to go with anyone else..... The debt just fell by 18 million, if he goes with Portpin ( I know that there was a 5 million limit from the FA, but still removes all debt and reprsents the best deal for creditors)

I am guessing at this, but; With Chinny converting the debt to equity and commiting to the CVA and football creditors payments - This would effectively wipe out all debts (Outside any new ones created by chinnys new overdraft)..So from an adminsitrator prospective, does that mean unless pst offer chinny the full 18 million, that Birch has no other choice (Based on his remit of getting best deal for creditors) than to go with Portpin? Is the coversion of debt to equity as big as deal as I am thinking? (Bascially taking 18 million quids worth of debt off the table). Where's Clapham when you need him.....

  19. All of that is based on the assumption that Brich will go to court to force the sale and the nice judge will agree. In essence what they would be asking, is to forget the guy who saved the business and make him lose a huge amount of money, so that another company can take it over - to make money. If Chinny (And I don't think he will even need to do this) offered to rent out fratton park at the same rates as the property developer, there is no judge in the country who wouldn't side with him. All chinny has to do is prove he will get / recoup more money, better return, by holding on to it. So next time you are with these very clever people from the trust, ask them what happens if chinny wins in court.
  20. As much as I would be delighted to see the trust take over, I just can't see it. Even if birch gives them the nod, Chinny will retain fratton fat pipes if it goes to court, but still to much risk imo for birch to rely on 1,900 pikeys stumping up a grand with 3 pay packets left before Christmas.
