I don't know is the answer as I am not the FA nor the independent disciplinary panel!! Ultimately they will decide how severe a breach of their misconduct rules it is and will sanction appropriately but, as I've said several times, the most severe sanction meted out is 10 games so that has realistically had to be the worst case outcome.

FFS it is not a straightforward comparison between Eckert and Biesla!!! It is a misconduct rule which encompasses the range of breaches that I've mentioned before and different breaches (of which there have been many by various different people like Prutton, Suarez, Di Canio etc) have been met with different sanctions . I don't know what is so difficult to understand either but you are doing your best to prove me wrong!

You keep referring to the EFL ruling... I said it is likely that he will get more than a warning fine to other breaches of the FA's misconduct rules. Bielsa was charged by the FA under their misconduct rules and received a warning. Other cases of misconduct (racism, biting, striking, betting etc) have received a variety of bans but 10 games but 10 games appears to be the most severe punishment handed out

I'm running out of ways to say this: The FA have charged Eckert with a breach of its misconduct rules therefore it will be dealt with in the same way other breaches of it's misconduct rules. Misconduct covers various misdemeanours from punching a ref to racism and many things in-between, it does not have a specific rule governing "spying" as it is not an FA offence.

I am using previous breached of the Fa misconduct rule as a precedent to be honest as hopefully that gives a more accurate idea of what to expect.

If it is more than 10 games (which I believe is the largest sanction handed out for misconduct charge under the organisation's rules) then the FA would be opening themselves up to a legal challenge.

There is no justification for a more severe ban which is why I am not expecting one. At most the FA might focus on the "bullying" which would exacerbate matters but it's highly unlikely that this would result in a lengthy ban (in my opinion of course!)

You are repeating yourself but that isn't making it any more accurate! The change to the EFL rules has no bearing on the FA investigation per se; as with Bielsa they are investigating a misconduct charge under their own rules system

No, the FA has charged him with a breach of one of their own laws. Bielsa was charged by the FA under the same law which is what saw him receive a warning (I don't believe there was a separate fine issued but I may be wrong).

It's my understanding that the FA investigation is aimed at individuals who have broken FA rules, not individual competition rules (particularly ones that concern conduct of clubs rather than that of individuals). Like I say, I might be wholly inaccurate but hopefully not!

The FA charges concern misconduct as an employee of an FA-affiated club. They are not governed by the EFL's rules so it makes no difference that the league brought in the new rule post-Bielsa. I guess we will find out the punishment soon but I'm not expecting anything more severe than a short touchline ban, possibly suspended. Hopefully my hunch is right!

You are referring to the EFL rule that was brought in following Bielsa's misdemeanours. The EFL fined Leeds Utd and subsequently brought in a new rule (albeit without clearly laying out potential sanctions). This saw Saints removed from the playoffs and docked points for next season. The FA rule that Eckert was charged under had been in place for over 20 years. It is the same one that saw Bielsa receive a warning & fine and has not been updated since...

That was an EFL rule that was brought in after the Bielsa incident and is what the club was sanctioned under. The FA rule regarding disrepute and misconduct has been in place for over 20 years now and this is what Tonda Eckert is being charged under. Bielsa received (I believe) a fine & a warning sona precedent has indeed been set

Why not? He was guilty of the same offence that Eckert has been charged with (arguably his misdemeanours were worse because he admitted he had been doing it all season) so one would assume that any punishment should be similar.
