Misconduct. Same as most other cases that end up in the FA disciplinary basket. Unless they go for the bringing the game into disrepute avenue. Misconduct will get him a fine and a short'ish ban, suspended perhaps. The other charge will get him 10 games or more.

Hah, the myth of "legal action" once again. When you break the rules,and that is undisputed in this case, you accept the punishment. There is no legal action, just plea bargaining at the time of the hearing.
