On the Claim Form the size of claim would be declared as “Unknown” but the point i was making was that the EFL couldn’t even afford £50 mill.

Do the EFL have anything up to £200 mill in their coffers to pay us in damages, interest and costs if we took them to court and we won? We could be the club that bankrupts the EFL. They cannot even risk it.

Yes there needs to be a deterrent but there will be a keeping in mind that if they kick us out then this goes one place only. Initially an appeal by the club and if that fails, it ends up in the High Court. That could take at least two years to get to trial. The EFL don’t want to be embroiled in lengthy and expensive litigation. They’re not that stupid. Hit us with a hefty fine and points, it’s the middle ground. They can amend the rules and they get it off their plate. Up to Boro then if they sue us but no longer the EFL’s problem.

Looking at the Chair of the panel - the KC, and assuming he’s chairing this, whilst a litigation background he has a strong background in mediation, arbitration and ADR generally. In my experience, not normally the ‘Hang ‘em’ High’ type. They look for some middle ground and are generally quite proportionate. Not soft. Just proportionate.

This is a KC chairing this. Not some muppet from your local boozer. You try to unduly influence these guys - and I know quite a few - they will go in the opposite direction. They don’t take too kindly to being leaned on.

The club including Tonda know more than we do about the case we’ve put forward. Tonda didn’t look like a man yesterday that fears he’s about to be sacked. He would have known yesterday if he was about to be booted.

And if anything came from some other third party implicating Tonda then it would be hearsay and carry zero weight

I’m not saying that you’re making this up but I struggle to see where text messages from Tonda would have come from. As this is not a court case there is no formal disclosure process here and if such texts did exist neither Southampton or Tonda would voluntarily disclose them. I cannot see why Salt would disclose them either. He’s not being charged with anything - criminally or by way of civil sanction.
