  7. As for Birch's personal liabilities, I believe he would be liable for the losses incurred during Admin if they go pop, just like AA would have been. The difference is that AA knew he was working for Chinny and must have had some understanding with the shark in relation to covering these losses IF AA hadn't been able to keep them (and thus Chinny's hopes of a payday) alive. I don't think Birch has any such reassurance and therefore will not take the risks that AA did. He's far more likely to put them to sleep than Handy Andy ever was. Shame. WTFILN?

  10. Would the PL/FL be able to redirect commercial income normally due to those clubs directly to the football creditors instead? The PL did something similar with Pompey and the PPs, didn't they? If they can't, I can see that being 1 way to get around any removal of the FCR in the future.

My tuppence-worth for the morning: 1: The player wage deferral doesn’t help them any in the long term, it’s merely a device the see them lurch to the end of the season and to cover Birch’s ass financially, otherwise it could be him paying their wages. Come the end of the season, those players will expect to be and probably will be paid in full, from parachute payments received. This though, assumes that the club is not liquidated beforehand, in which case there won’t be any parachute payments. Would the PL pay the outstanding football debts using this money anyway, or keep it for themselves? It also assumes that there’s no judgement against the Football Creditors Rule before the summer. If I was one of the players I’d be thinking long and hard about my chances of ever actually seeing those wages. 2: A slight change of perspective for the Football League to consider. Pompey have already blown off a whole load of debt, for which they got a 9 point deduction which made no difference to their relegation. If they pull this off again, they’ve blown off a whole load more debt in return for 1 0 point deduction which may, again, have no material effect on their league status. The Football League will argue that they have punished PFC in accordance with their rules. However, leaving aside whether PFC have been punished for their despicable behaviour, what precedent does it set for other clubs? Where’s the deterrent to other clubs taking similar cavalier approaches to finance and debt? Don’t the Football League, the Premier League and the FA have a duty of care to the professional game in this country to take all reasonable steps to protect clubs from themselves? If Pompey fans argue that “it’s not our fault, we’ve been pardewed by a succession of dodgy owners” well, all well and fine. Don’t the stewards of the game have an obligation to protect clubs from that happening to other clubs? Unless they take more action against Pompey, they’re saying to other sharks “come into our game, bleed our clubs dry, leave their corpses to die if you like, the worst we’ll do is give you a tiny points deduction that you probably won’t notice”. Regardless of the clubs involved, that’s just not acceptable from the authorities. Whether they hit Pompey again to send a clear message or tighten their rules doesn’t really matter (well…) but they must do something…

  21. Sounds like Birch is trying to inject a little reality into the situation after the weekend parties where everyone celebrated "getting rid of Chanrai" (errrr, no you haven't) and having a "proper admin" and a rosey(arf) future. Yeah guys, maybe not, eh?

Any case hearing the validity of Chinny charge will examine the entire sordid history of his involvement in the club, something that will make this thread seem like a toddler's bedtime story, and will take flippin' ages. Chinny has the money to pay for that (he'll lose £17m if he doesn't) but do Pimpey? Their only saviour may be that Chinny won't want everything laid bare in a court of law (and he likely won't) so may cut a deal. But, if he plays hardball and says he'll fight it all the way, can Birch really get involved in litigation?
