I have a potential contract but am falling foul of IR35 (independent company assessment not CEST). Do any Saints fans have any expertise in this area and are willing to provide advice? Even around umbrella companies if that is what I need to do. Thanks.
Tamesaint Posted Monday at 07:24 Posted Monday at 07:24 I haven't had any IR35 dealings for several years now but check the time limits imposed by the regulations. They used to be (and still may be) relatively short so a gap between April and July may be sufficient for you to escape IR35 penalties. Sorry I cannot be more up to date.

So it is due to your contract that you're falling foul then? What type of job are you doing?

Previous company, different part of the organisation, 12 month contract. Different skill set maybe 10% overlap. assessment does not like the fact it is the previous company employed by and they don’t understand the roles as it seems if I came back as an administrator it would say there is an overlap.

Yeah, that's an issue. They usually like a 6 month gap. I would consider going Inside IR35 for this one if your company will do it, through an Umbrella. I have used Giant Professional in the past and they are decent (and the cost is negligible). I currently work outside IR35 when consulting, but that's only because it's around 30 days per annum, per company, so it is clearly not disguised employment. I am relatively clued up on it having contracted on and off for 15 years, so if you have any questions let me know. 2
