I know technology has moved on but surely they should have eexamined the scumbags clothing more closely at the time . It is possible that there is a reason why this person cannot take leave at a specific time. The public sector will be stopping people having holidays or going off sick during the forth coming strike at the end of the month. They will only be allowed to go on holiday if the have booked a holiday well in advance of the strike day. equally an employee will not be allowed to self certify sickness unless it is supported by a medical certificate Fmed 3. As for private sector if your talking of financial companies such as the pru they are pretty stingy in let people of at xmas and during the summer. They tend to allow staff one or two days of but no more. And staff with families tend to get priority. My girlfriend works there and I have always wanted to spend a week in new York at Christmas / new year but they will not let her have a week off despite her giving 10 months notice. Anyway back to the point in question as long as the company are not reducing the contracted holiday hours or giving less than than the minimum work time directive rates they can refuse holiday requests. On a similar and slighty different point of view I am currently digesting two case re holiday entitlement and sickness with a recent judgement from an EAT Fraser v Southwest London St George’s Mental Health Trust and NHS Leeds V Larner (awaiting COA ruling) it may in many ways overturn the ruling in the Stringer & ors v HMRC. I hope so as it will save the public sector millions

Colin jb In the UK the law on holiday pay from April 2009 states that everyone is entitled to 5.6 weeks (statutory) holiday per year except for the self employed, armed forces, police and civil protection services. Her company may give you more holiday (contractual) but cannot give her less than the statutory minimum. Her company cannot reduce her holiday to below the legal entitlement , they cannot do this. I would be interested in seeing what her contract states, Its sounds if they do this then they will be in breach of contract However, it sounds like this persons circumstances are such that as her employer has givin the minimum 28 days paid holiday (including bank holidays), then they must continue with this. Even if there is breach of your employment contract, then they employer will have accepted the breach. I look forward to hearing from you
  13. Doctor on call the working time is enshrined in uk employment law . It is the working week hours that individuals can sign out of . Originally employees were entitled to 21 days holiday however this changed a couple of years ago to 28 days 21 holiday and 7 public holidays . There is a case being heard and the matter of the 28 days . It's a complicated case . It will not imPact on Colins question but more to do with pro rata if someone leaves their employment
  14. Colin the working time directive is quite explicit. The minimum holiday is 28 . If the company is not allowing them to have holidays for a specific reason such as economic reasons then they can do this providing they have given notice , allowed the individua to be recompensed in some aspect then they can tecnically do this . If not they will be in breach of working time directives . I'm assuming you are working for the private sector and not public sector? Send me pm and let me know more details

There are those in RBL Kirkwall who have forgotten the motto service not self and have it back to front. self not service. I was on the commitee here for a while and the concept of being a place for ex service has sadly faded RBL needs to reinvent itself.

Yes there are lots of service charities RAF Benevolent Fund , RN Benevolent fund Army benevolent fund Erskine Homes, The Haig Fund (more properly the Earl Haig Fund) is a charity set up in 1921 by Field Marshal Douglas Haig, 1st Earl Haig to assist ex-servicemen. Today, the Haig Fund continues to support veterans from all conflicts and other military actions involving British Armed Forces up to today. Its members sell remembrance poppies in the weeks before Remembrance Day/Armistice Day. There was the Normandy Vets association as well as individaul Regiments and Corps associations and H4H "It’s about the 'blokes', our men and women of the Armed Forces. Bryan Parry set this up for the following reasons "It’s about Derek, a rugby player who has lost both his legs, it’s about Carl whose jaw is wired up so he has been drinking through a straw. It’s about Richard who was handed a mobile phone as he lay on the stretcher so he could say goodbye to his wife. It’s about Ben, it’s about Steven and Andy and Mark, it’s about them all. They are just blokes but they are our blokes; they are our heroes. We want to help our heroes." Also Royal Hospital Chelsea - Lets not forget then I do not have a problem with any of these charities but I do have a concern re the RBL. There are lots of British Legions up and down the country and rightly so , But some are struggling due to lack of income, some have become working men clubs in order to generate income and to survive. Certainly that is the case in many legions troughout scotland but at least they are still generating funds to help thiose in need. Some have had to close because they are no longer economically vialble. The other issue I have is because if it was not for the likes of H4H the forces would not have personal recovery centres around the country , Yes we have the Defence Medical Facility at Selly Oak but successive governemts have closed all military hospitals over the years. Which were and in my honest opinion a valuable asset to all military personnal. I digress a little but if it wasnt for H4H and the like Im sure the governments of the day would not have dipped into coffers to provide centres for injured servicemen AgainThorpe I apologise to you

  25. Marsdino not patronising you apologies if you thought I was . I stand by my comments that it was the Blair gov sent our troops out . There they didn't go by choice. I could put pictures up for you. The military medical services deal with many more civians casualties and normal medical problems trouble is these aspects of our troops are rarely shown . These are the pictures I was referring to . Afghans are killing afghans have been and always will do . In Iraq innocent civilians are still being killed by either Sunni or Shia Muslims . The media over here no longer report those matters . Look at Syria and Bahrain . I was a medic for many years so I happen to know about civilian casualities . As a medic we treated the casualties which ever side they belonged to . So please do not lecture me on civilian casualties . We may disagree on this but we are both saints fans and I respect your view point
