Once upon a time an alleged rapist would say it wasnt him. With DNA they cant do that so easily so the arguement usually comes down to consent which as UJ says is difficult to prove or disprove. The law needs to protect people from the affects of booze and drugs (the fact that one drug is called a date rape drug says it all) but proving intent/none consent comes down to how successfully the case is put and what the jury thinks. It is a huge step forward that police are putting more of these cases forward but the CPS still have a difficult job in deciding what to charge as the case neds to have a reasonable chance of sucess in court. Cases are still being dropped although the CPS believe the victim on the basis that there is no reasonable chance of conviction. The good thing about the high profile Evans case is that, hopefully, it will make people think twice about what they do with someone who is not in control of themselves. Not only do the CPS use specialist teams for rape cases, but they also use specialist counsel to prosecute them. Murder cases don't even get that level of specialist prosecution.

Good point. If she had assaulted a police officer she could have been done for being drunk and disorderly so that she woud be held responsible. Same as if you rape somewhen when drunk, that is no defence. I guess it is about the exent to which you impose your will/actions on someone else and to what extent you take advantage of someone who is not in control or able to make reasoned decisions.

The important thing here is tha the police and CPS thought there was enough here to take the case to court where a jury found Evans guilty. Everything else is just a lot of hot air. You can make your own mind up but that does not stop him being a convicted rapist. -
Taylor seems to spend most of his time defending the indefensible. Ok, he is a union rep, but perhaps if he had trod a harder line from his early days the footballers of today wouldn't think that they are something special and in some cases, above the law.

I've not seen the CCTV footage but apparently she was all over the place including squating down and having a wee in a shop doorway. She says she thinks her drink was spiked. Nothing showed up in the toxolgy report but apparently if she had been given something it could well have cleared her system by the time she was checked.

Yes quite. It is not as if they had all been out clubbing and getting wrecked togther. Evans and his buddy were both sober and knew exactly what was going on. Sadly for her instead of making sure she got home ok, his mate textd Evans saying Iv'e got a bird and took her back to the hotel room that Evans had booked for this very purpose. She was dragged there kicking and screaming but at the same time would a decent person have done what these two did?

Good point, but you woud think that if two of them had been going at it she must have realised that something had been going on "downstairs" the night before when she finally woke up!

I have not seen the statement but apparently he is now sorry for the grief that the victim has been put through - although he still says he didnt rape her. I think he is more sorry that he can't get a job that will give him access to plenty of willing females

Drink/drugs do affect people's ability to make rational or considered decisions and often what seems like a good idea when you are smashed isn't really. There is a guy missing in Maidstone at the moment who left a club hammered and was last see on CCTV walking down by the river. No doubt seemed like a good idea at the time but the poor guy probably ended up in the Medway and drowned. Some have argued that if you get into that state you need to take responsibilty for your actions. There is a counter arguement that just because you are in that state, it doesnt mean that people can come along and do what they want to you.

If is the same website they also claim that she wasnt that drunk because she walked into the hotel ok. Not withstanding that there is plenty of CCTV footage showing she is clearly sh*tfaced.

Which then returns to the arguement that if someone is that out of it how can they possibly be in the right state of mind to give consent.

I don't know if it was true but the police and CPS would have been aware of it. There was a website set up to discredit this girl and make Evas look like a victim.

Men have been convicted of rape against prostitutes. Being a hooker didnt seem to work against their "character." It could also help explain why she had no recllection of what happened to her. Having this stuff in your system doesnt make you immune to rape.

Let me get this right. This person is saying that the victim called the police to report a missing handbag and the police suggested that she might have a case for rape against two well known footballers? Blimey that was a bit of a leap wasnt it? The Plod are getting better. From a missing handbag they immedialety deduced that the person had been raped! I find the article deeply unpleasant. You would think that woman would stick togther over something as fundermental as rape but now - yet again we have a sneering snidey suggestion that because she was drunk what did she expect. At least good old Ched didnt pour boiling water over her or stick her with a knife. Go Ched. No, all he did was walk in, rape her and walk out again. Rape is rape. It has little to do with sex and more to do with power. Evans had already expressed his thoughts of his powe over women by saying he could have any one he wanted in the clubs he goes to. This poor girl was just another that he has used to massage his ego. Men have been doing for it ever and women have been fighting it for ever. You would think someone with enough clout to get a gig on a Broadsheet would realise that as long as people like he write stuff like this, blokes like Evans will think what they did is actually ok.

I think in the main we are dealing with people who are psychopaths who have hitched their wagon to Islam. I am sure there are many Muslims who wouldnt be happy if their God was mocked but doubt if they would arm themselves to the teeth and go and massacre some pen pushers. Most religions seem to have some followers who seem to think that no one else is allowed to have any other faith and will take things to the nth degree sadly. Christians are still maiming and killing each other in some parts of the British Isles.

Where indeed. If he had been done for speeding we wouldnt be having this thread now. Certain crimes at the higher end of the scale bring criminality into sharper focus though. If Evans was to go into schools and talk about how he was wrong and how rape is abhorent then maybe people would have a different view. I dont think he has helped himself with his attitude but even if he had been remorseful and contrite the situation might still be the same.

Because they represent their communities/towns/citys. He used to be refererred to as Sheffield United's Ched Evans. If an England player was to do something like that whilst away with the team it would reflect on the country too because they are there as a representative of the country.
