The FA can’t implement a points deduction, that’d have to come from the EFL?

A week ago, everyone was saying how it’s a minor infringement and laughed it off. because the EFL have brought into the pressure applied by Boro and the media, it’s now this huge issue. if parsons had kept his mouth shut and employed a decent legal firm from the first minute, we’d have been at Wembley today.

Unfortunately not. Radio silence pretty much since the event other than last week when I was told the above. This was before the additional charges, for what it’s worth. I get small snippets, but a relatively senior figure who doesn’t often say much. Generally speaking, saints are pretty good at keeping things in-house.

Covering what has already been said, but the club grossly under estimated this and that is on Parson and for that, he has to go. Long story short, I’ve a friend of a very close friend who works within the club. An area who would have been a very big part of this whole thing. When news broke, the word was “expecting a fine and points, hoping to mitigate the points”. They never believed expulsion was on the cards. Clearly we were guilty as sin, but a decent defence barrister from from minute go, I honest believe we get away with it, or at the very least would be heading to Wembley today (with or without this still lingering over us). From the trial by media, to members of the Boro camp on the EFL board and potentially commission, there were so many holes that at the very least could have been exploited to delayed things. Unfortunately, this sums up Sports Republic. Naive and incompetent. Of course we get the only Serbian who isn’t a fucking nut job.

Doesn't matter though. Its still a rule breach. If you hit someone drink driving, you wouldn't get a lesser sentance because you said sorry. Sorry but the first point is rubbish. He knew the rules. Even if he didn't, someone would have told him - you shouldn't do that. Just own it. Argue your case that its a bollox rule and is applied nowhere but the EFL, but don't lie. Second point. Why do it then? Its a weak arguement.

My personal view, which I have remained consistent with since the news broke was; You clearly get an advantage, we wouldn't have done it otherwise. However, I don't think think the advantage is all that significant. Its a 1% gain which you see all over football in different shapes and forms. For me, diving is worse, this is on par with timewasting - I feel that strongly about how insignficant it is. It was obvious from the get go that; 1. we'd done it before, we would have been at this all season - without a doubt. 2. Senior figures (i.e Tonda and Spors) would have known about it. 3. It wont just be us. This will be common practice for clubs with manager from the continent. Whilst it is technically correct, 'cheating' feels harsh. Gamesmanship is more appropriate. He saw an opportunity to either get some ££ or get a free shot at the PL. It worked. People arguing he done it for sporting integrity are absolute idiots. It always was and will be for the money. it wont be pretty reading, but again, it doesn't take away from the fact its a minor crime in the grand scheme of things. All that being said, as yesterday progressed, I came to the realisation that the EFL had no alternative option but to kick us out. It was proven we'd broken the rules and unless they implemented a ridiculous fine, there was no alternative deterent.

Is that a precdent by the way? Surely his own arguement back then would counter any argument now...

No chance in my opinon. We've broken the rules, with no precedent to fall back on, I think we're royally fucked. Much like you, had we had a decent defense lawyer.. things maybe different.

further to this, given the EFL have clearly pushed for the harsest possible sentance, if a judge override upon appeal, does that essentially mean that Boro do not have a leg to stand on in terms of any legal claim?

Can someone more clued up than I am explain what Gibson could realistically sue the EFL for?

I personally think the first part will be thrown out as not relevant at this stage. We've admitted it. If we do have evidence of other clubs doing the same thing, it does some what mitigate the seriouness of it however.

For what its worth, I've been told we had some mitigating evidence against the whistleblower and that this is a widly carried out activity. Don't know a lot more than that though.

Yep. All the EFL will care about is their ££ here. Moving away from Wembely will seriously hurt their pockets.

I'll be amazed if leaks don't start to appear at some point this evening. At the very least, you'd imagine we'd have an understanding of what the potential punishment looks like.

I had a breif flick through his posts and it appears to consist of not much more than false ITK claims about spygate and avidly defending Cameron Archer. Can file this one under WUM or aggrieved family memeber of Archer.
