  1. Parties exchange skeleton arguments and then make submissions to the panel
  2. I though it was fine what’s else can he realistically say with the appeal pending
  3. Loss of opportunity claim
  4. If we have good evidence of that we say the practice was widespread, the EFL knew or ought to have known about it , failed to issue warnings and the punishment is clearly draconian/disproportionate where others have not been sanctioned at all
  5. It’s not a no brainer as if we obtain the injunction we will need to give a cross undertaking in damages which means if our claim is unsuccessful we will have to pay damages for the losses suffered by the EFL as a result of the postponement of the game.
  6. I think that’s spot on - if you are going to expel Southampton then logically Hull are promoted by default. The fact that they aren’t is a product of the EFL not wanting to lose revenue , rather than putting Boro in the position they would have been in but for the offence. I cant see how the club can properly prepare its appeal in 24 hours so I would be considering an injunction
  7. I don’t see how we can be expected to properly prepare for an appeal within 24 hours of a decision that is on one of the most draconian in footballing history. That of itself must be grounds for a claim that the appeal process is irrational. Someone mentioned we have signed an agreement not to refer matters to the Courts but if I was the club I would be looking at the legitimacy of that. I would also be looking at the extent to which other clubs have been engaged in similar practices and if so why the EFL has not take action there. From what I read these practices are widespread. If other clubs have been found to have engaged in ‘spying’ what will the EFL do there ? There has to be a similar sanction - relegation ? We have admitted breaches and deserved a significant punishment but this is disproportionate and it can’t be said that absent the offences we would have lost the game. That’s absurd as we clearly won that second leg due to being fitter and having the better squad. The decision is out of all kilter with the offence and it punishes the fans and players to an extent totally unnecessary. I’m not sure what the panel was thinking really and the appeal panel will have some serious thinking to do to try and correct this.
  8. I struggle to see how the appeal can proceed tomorrow as we would have less than 24 hours to prepare for it - rules of natural justice etc would be infringed and that would leave the EFL open to a claim. Has to be a real possibility the final is postponed

  10. I can’t seem them kicking us out as there would have to be an appeal and that could take weeks, if not months. Equally if the EFL got the process wrong they would leave themselves open to a damages claim for very a substantial sum of money, so if you were them you wouldn’t take the risk. A fine or points deduction is the most I can see.
  11. Seemed fine on the pitch after the game
  12. Kane was shite in that Bayern game and Stewart was far better on Saturday.
  13. He is a quality striker when fit. Have the Arsenal centre backs faced a better striker this season ? Reminds me of klaus aughentaler
  14. Stewart doing a very good impression of klaus augenthaler
  15. £8million I believe
  16. That’s what I was thinking - why not the usual navy blue ?
  17. Totally disagree We increasingly look like the team to bear We now look very solid and for the most part were comfortable today against the team that has run away with the league Credit to the coaches
  18. How many of our players would make the Fulham team ?
  19. Decent window - 9/10 from me We usually buy loads of shit players in January and this time we have loaned just one so feels like progress
  20. He won’t see out the season but I can’t see them sacking him now. They will give him the January window, bring in a few players he has no say in that don’t improve the team, results will continue to be poor and then they will sack him. Following that they will appoint an experienced old head we have never heard of from one of the European leagues ( perhaps the Greek league this time) to shepherd us to the end of the season.
  21. Burt Reynolds ?
  22. The football has generally been terrible to watch which you could forgive if it produced results but it doesn’t, so why do we persist ? I think that’s what really pisses people off. I would be interested to know if the slow build up play (which is killing us) comes from the club, the manager or the players ? The failure to stop crosses into the box has been the case from the RM years is the other major issue for me. I wouldn’t be surprised to see us go down but I think next year will be more likely
