Don't agree, we had a contract with them and they broke it, so you're saying even though we had a binding agreement that he would be our player come a specific date if the agreement wasn't cancelled we should ignore it and throw silly money at AM to get him. It's like going in to shop and seeing a bargain for 10 quid but saying you've seen it in another shop for £300 so I'll give you that. People would think you're mental. Oh well, either way it'll be interesting to see what comes out of it. If we get more than the £1.5m then it's worth pursuing.

We should get more than that, we'll get damages if the contract has been broken, probably get 4-5m from Atletico if it's proven they have broken a contract with us, they could end up with nothing out of this and would serve them right.

Toby keeping his options open but I'd find it foolish with all this in the air that he'd want to do anything until it's sorted. I suppose he can have his medical then sit back for a while and see how it pans out.

Toby is easily worth 11m+ but when there are contracts in place and god knows what else happening that no one on this forum knows then I find it all a bit silly to bash the club for not doing things properly. Obviously the forum would be boring without the speculation though. The silence coming out of the 3 clubs now is deafening though so I'm sure there's loads more to this than meets the eye and there will be lots of negotiating left to do. Hopefully we can negotiate with AM and use our legal standing to get toby, if Toby goes to Spurs AM could end up with nothing if we get the compensation so maybe we can give AM a couple of mill like you say and make it all go away if Toby comes to us.

Why throw more money at a club to secure a player we had an agreement to sign? I don't care what he's worth, he's only worth that because he played for us. Thank god some of the people on this forum aren't running the club?

Bet Victor has Toby joining Spurs and Saints at both 5/6. Lump on spurs if anyone thinks he's going there.

Not sure what happens if AM refuse our 6.8M to make Toby ours as surely he is ours once that payment has gone through and we've taken up our right to buy.

If we no longer have Morgan or Toby there is a massive hole so I would expect to fill it with players capable of coming straight in and filling the gap.

The club could look to the courts for the equitable remedy of specific performance. Enforce AM to perform what the contract was, in other words force the sale through to us. Whether they'll win or not is another matter as saints would have to prove something like we can't get another player like Toby and I agree what the likely outcome will be will a damages figure of maybe £4M to £5M meaning Atletico will be in the same boat as if they sold him to us which will serve them right. Also it might be the Spanish courts that sort it out and all they might do is get Athletico to pay the cancellation clause which makes the whole contract process pointless.

Maybe he's our player pending our payment, either way if the deadline has lapsed we have the right to make that payment and make him our player.

It would seem to me that atletico couldn't afford the buyout clause which meant the only way they could get maximum from him was to sell him to spurs then pay us the money otherwise they were stuck with receiving 6.8m from us and that's it. Athletico being greedy. Not sure why we should just go to them with more money when we had an agreement in place, who cares how much he's worth, his value increased because he played for us. I hope we stick to our guns and rinse athletico and maybe spurs for all they can.

There's the principal of it all, one club can't shaft another and think they can get away with it, we're not little old Southampton anymore and if we have a contract with another club they will have to fulfill their obligations. There's probably a number of ways this can go, they pay the compensation we're owed and we go away and let Toby be a spurs player. We try and get a specific performance order to force through the contract that was signed, in effect pay the 6.8m and Toby is our player or there is a load of mess and no one knows what will happen. Do we own the player registration though? As The9 was pointing out, he is legally our player now, can we stop him going anywhere else?

I'm sure if everything on offer to Toby, wages, bonuses etc, were all equal between saints and spurs he'll join us but it's not going to be equal and he'll go where there's more money on offer.

So what if atlico have an agreement with spurs, I'd be surprised I'd they didn't. It's the agreement with saints that we need and from the info from monk that looks likely over the next day or so. People need to relax.

It's going to come down to what Toby wants. I'm sure the club will meet the valuation and try their best.

Spurs will pay Toby more than we will unfortunately so depends by how much and if Toby views it as a monetary decision. Just got to hope koeman can work his magic.
