Yes, you could under the law (subject to it having been not of satisfactory quality or not fit for purpose when sold and being an item that should reasonably be expected to last for 18 months, in this case). The problem is that after six months the burden is on you to show that was the case. Your claim in relation to the faulty goods is a claim based on the breach, by the retailer, of contract terms implied under the Sale of Goods Act. The limitation period in law for a claim for breach of contract is 6 years. The maufacturer has nothing to do with your relationship with the retailer. If they have provided a guarantee though, they are effectively offering to step into the retailer's shoes. Manufacturer's guarantees do not usually offer you any protection that the law doesn't already give you, they just give you certainty by providing a defined way of dealing with the problems and stop you having to deal with some useless oik in a shop. But whether a guarantee is given or not, you always have recourse against the retailer (subject to the facts).

If it was merely a transfer of liabilities to a chancer hoping to scrape survival for a couple of years and sneak dubious funds in the back door, if they can be found, you probably wouldn't. Do you honestly think you have a pot to **** in? Do you feel comfortable being owned (if indeed you now are) by someone who lies about being a Doctor and a UN Goodwill Ambassador? You will sell Distin. You will get a worse replacement, if any. You will go down. You will go into admin and the "Dr" "Goodwill ambassador" will disappear pretty sharpish after losing his £1 investment.

Your contract is with the seller and in fact you could bring a claim at any point within six years from the purchase (although you may have some evidential difficulties). Chrisobee - it might be worth mentioning that you intend to issue proceedings in the Small Claims Court if this isn't resolved within two weeks. I have worked in companies in the past where the mention of legal proceedings in customer complaint letters ensures that the letter is passed before a member of the in-house legal team, rather than customer services. If the compaint is genuine then this usually results in the lawyer seeing how ****e and ill-informed customer services are and in you getting your problem sorted.

Bizarre. Coincidentally, the player signed was young-ish and cheap and at the time we had a policy of filling the team with young and cheap players. We were also selling a player to the club of Mr Pulis so had the option to take a cheap punt on this box-ticking young lad. Well, frankly one does sound like bull**** and one doesn't. Maybe Torres could have been a bit more friendly with the way he posted it but this is a football messageboard FFS. If you are going to post nudge-nudge wink-wink Machiavellian conspiracy posts that fly in the face of a much more logical explanation and are not prepared to back up the said theory on the same public forum then expect, quite justifiably, to have the finger of bull**** waved in your face.

  11. Better to have a "me first" culture and be open about it - that way everyone knows where they stand. Also - what's wrong with a "me first" culture? Within the boundaries of the law, surely that rewards enterprise and ability? Give me a meritocracy over some sort of perverse egalitarianism any day. Some people are ignorant, stupid, and incapable of interacting with others. They deserve to live in **** holes. Some people are unlucky and victims of circumstance. Some people are lucky and privileged. That's what happens when there are billions of people. Get over it. Most people are reasonable and will help others rather than tread on them.

    St Will, next time you see Kadeem Harderington at a match I really think you should take a photo and then disseminate it to all local youth clubs and golf clubs as this man shouldn't be allowed to pray on novice golfers who know no better than to hand their hard-earned to him for some of his motivational "mind bullets".
  16. Well that just shows that whoever judged those is either a numpty or wasn't actually watching the match. He was ok. Not bad, not great. Should hopefully get better as he settles in. If anyone thinks he had a better game than Harding, Trotman or Perry then i seriously wonder what they were looking for.
