This was something raised by BTF and it would seem a perfect solution; http://www.bevirs.co.uk/commercial/overage.htm That explains it quite well, but goggle "Overage" and there is plenty on it. For what it is worth, I don't buy the tesco deal and i am not convinced that robinson has actually bought the other land. Apart from the news, the only info is from teh bbc (who have been poor on details throughout this whole thing) is a line that says he has exchanged contracts. If the land was so important to Tesco, they would have bought it themselves.

Some of the pdt guys are saying that the 31st will replace today and then a hearing date will be set for after that. So that suggests that pkf/robinson/council etc etc. are ready again. I am pretty sure they will have to pay costs to date, which ever way the judge goes.

One poster says it is the council, but they don't even pick up on that. It's the not caring where the money came from, that got them into this mess in the first place.

The original terms The Portsmouth City Council have agreed to loan the Pompey Supporter’s Trust £1.45m in order for them to continue to edge closer to the takeover of Portsmouth Football Club. Councillors voted unanimously to back the PST (Pompey Supporter’s Trust) with the main bulk of that loan going towards the purchase of Fratton Park. The option approved (option two) was proposed as follows: Make budgetary provision for £1.45m of loan support to the PST for a 12-month period ending 31 August 2013, which shall be conditional upon: i) The Club owned and operated by the PST being deemed to be the “Relegated Club” and that transfer of membership of the Football League is obtained ii) The business and assets of the Club are acquired for £7.68m and that this consideration for the acquisition includes provision for the full and final settlement of the Football creditors iii) The Club owned and operated by PST obtaining all rights to the £11.7m of parachute payments iv) Obtaining a first legal charge over Fratton Park v) That no other legal charges are made against the income or assets of the Club beyond those set out in the PST Business Plan received on 1st August 2012 without prior consent of the City Council vi) That the City Council must obtain an assignment of unencumbered parachute payments (preferable) of a sum sufficient to repay the loan from the proper body entitled to provide it or alternatively that an investor guarantee is provided by the PST for the full £1.45m vii) A “subscription” agreement (or equivalent) for each of the Fan Share Scheme, High Net Worth Investors and Associate Director Scheme is in place which is satisfactory to the City Solicitor setting out the conditions of the investment and disinvestment into the Club and which does not allow any disinvestment until such time as the loan to the City Council has been repaid viii) Proof of funds from the Fan Share Scheme, High Net Worth Investors and Associate Director Scheme for the sum agreed in recommendation 2.3 has been demonstrated to the satisfaction of the S151 Officer and which are subject to the subscription agreement (or equivalent) set out in vii) above ix) A suitably skilled and experienced Chief Executive is appointed to the Club by the PS

I would have thought so. They said if the club was liquidated, they wouldn't get any money back - Suggesting that if they do take over they will get it back.

None of that will be changed substantially by the extra funding as far as I am aware. Thats from s maskell on fol- Which seems to me to confirm that they have got extra funding.... and the council would be the most obvious route.

I am pretty sure this is what is happening. farmery said he hoped to be able to announce some good news towards the end of last week. Then there was the meeting with the councillors on Friday - why would they need to do that? If robinson still can't commit, they would get thrown out of court tomorrow if they didn't have funding in place. They give the council a chance to save the club and they are all heros. It won't be the first council owned stadium and there will be a few angry taxpayers, but that will be that. At a guess, I would say the pdt have found their 3 million quid........ They just need the udge now.

Someone is claiming on fol that the extra funding the Sun are talking about is the Council agreeing to loan them the money for the stadium. Whilst the Sun story appears just a rehash, something has promted them to run it and there was a meeting on Friday between the pdt and the council. If Robinson is still stalling they will need 3 million (Minimum) by tomorrow. It would be entirely logical for them to go back to the council and ask for the money. Whther they get it is another matter.

I just read the article about how the trust are meeting up with the councillors on Friday to bring them up to speed. Anyone else think that they might just slip in a request for 3 million quid whilst they are there? ...... Do you remember that loan we talked about 6 months go, well, it's like this.......
