Maybe not now, but if you got judgement you would have first dibs on the proceeds of liquidation when Gaydamaks land is sold. Although of course, if the Gaydamak land and NewCo happened to end up in the same beneficial ownership, then that would be meaningless and any legal costs would have just been money down the drain.
