I cannot find any back door escape clause in the Completion Statement, so let's wait to see what Baker Tilley have to say on the 2nd of April. To FC- re point 2 : I think the next tranche of the parachute payments are being used to cover SG's debt. Re point 3: I don't think there is any intention of honouring the CVA payment.

I suppose only Baker Tilly know for sure.

Not sure of the legality or how it is enforced, but this is what the CVA Completion Statement says : "As detailed above PFC10 is obligated to make a contribution to the Liquidation which ensures a dividend of 20 pence in the pound, before costs and expenses, is paid to all unsecured creditors." EDIT : just found it : "This obligation will be formalised by way of a binding sales and purchase agreement in consideration of the transfer of the business and assets to the Newco" ( Appendix 1 of the Completion Statement )

I think there is something to do with an agreement to supply Baker Tilly with the funds in accordance with the CVA schedule.

Surely they cannot be 'debt free' ; there are Balu & Sacha to consider, plus the unsecured creditors have yet to be consulted over a possible CVA. Or am I living in a parallel universe ?
