Accused of being a 'nutjob' or 'obsessed' is a compliment. We know we're pretending to be looking at the bigger picture when in reality this thread is as long as it is BECAUSE it's Pompey. To suggest we don't know how it comes across is missing the point... (that said, there is a moral side to it all the same, but, yes, that's not the MAIN reason this thread is as long as it is)

So, given it's Birch's job to choose the 'best' deal for the creditors and we now have two "identical" bids on the table (indentical in terms of what is being offered to the creditors), what does Birch do? Toss a coin? Or go back to the creditors and say: "Ok, you choose who you think will honour the CVA..."?
