Your point seems to be that he should either demand a transfer (which would be idiotic on his part given no other PL team would be stupid enough to sign him) or refuse his wages (which would also be idiotic, given we have agreed to pay them) because the manager won't pick him. Yes, they are saying that the logical construction of the Equality Act only allows for a binary interpretation but they aren't issuing a judgment on whether sex actually can be somewhere on a spectrum as a matter of biological fact. I'm not against the ruling but there will still be people who push the limits of the biological definition (butch birds, etc.)
