Dear All

 

I know many of you are sitting tight eagerly expecting some news, so I'm taking 2 minutes out to make you aware of some issues that we are trying to resolve to complete our takeover.

 

Please respect the fact that I cannot go into the finer details of some of the legal issues - myself, colleagues and clients are bound by a non disclosure agreement in respect of the sensitive details, and this will be adhered to at all times.

 

You may be aware that a brief announcement was made earlier this afternoon confirming that, despite our continued efforts, there are some outstanding issues to resolve prior to us being in a position to completing our takeover. There are to my mind 2 legal issues - questions which need to be answered. These I am sure will be put to bed without delay. A further remaining issue is that of the Football Leagues position over our license. Again, it would be hoped that this can be confirmed without delay. My colleagues and I, clients and the Administrator have made our position clear to the Football League on the detail of this issue. I cannot go into it now, but it is cricitcal that this is resolved, and in a timely manner. We will continue to work hard with the Administrator to resolve this, as this is in my view the final piece of the jigsaw.

 

My hope is that all outstanding issues will be resolved without undue delay, as we are itching to get on with the important job of rebuilding this great Club - both for ourselves, the supports, and the wider community.

 

I hope the next announcement that we can make will be to introduce your new owner and Board, and our opportunity to set out our vision for the future.

Thank you Tony for the update. It is nice that the fans are the first to hear for a change. My hopes and prayers are with you for a successfull conclusion to the take-over. If it takes a few more days it will be woth the wait providing the answer is a positive one.

Thank you for the update Tony. I know all too well these hic-cups that hinder the progress of deals being concluded. Im sure all of us appreciate the amount of time and effort you are putting into this deal along with Matt and Leon. The jigsaw will fit into place eventually and we will all be much better off for it. We have waited years for the end of the dark Lowe era so waiting hours or a few more days would be a price we would all gladly pay to see the end of it.

I'd be very surprised if the FL did anything other than re-iterate that the penalty stands, but if the new owners (when they are owners) wish to appeal, they are welcome to do so through the official process and timescales.

 

Presumeably such a response doesn't really affect the purchase.

SSN have just stated that the delay is that the FL want Pinnancle to sign something saying they will not appeal 10 point deduction .... Pinnacle & Admin don't agree to this .... everything else ok .... BUGGER!!

Personally, I think we're missing something crucial in all of this, and that is the arrangements that lead to Saints becoming a PLC in the first place! I don;t what to drag up old whatshisface, but the simple fact is, the league sanctioned this reverse takeover, and now it's gone belly up, they're sticking their head in the sand and denying the facts, and those facts are stated in their rules AND the law of this land.

 

The FL should back down, allow the takeover to go through, remove the 10 point penalty AND THEN change the rules to capture this loophole or accept that it is legal for clubs to exist and trade in this way!

 

The FL is acting just like F1 on this and it is the fans that suffer, nobody else.

 

Boooooooo FL! Bunch of old timers, running out of time, tick tock, tick tock!

How fair will the FL look if they let a club go out of business just because they were not willing to let a fair impartial trbunal look at their decision on points?

 

They would look awful and IMHO wouldn't let it happen

It is good to be kept informed of the situation. My understanding, which may be entirely wrong is that the league management consists of some paid employees and a group of other clubs chairmen. Hardly an independent, unbiased body in my mind to give us a fair hearing. It seems they can make up their own rules and revise the interpretation as they go along. If you don't agree they dock more points and or see you go bust.

No it didn't, we were in the FA Premier League at the time, nothing to do with the Football League.

I'm no legal expert but surely 'we' (the club/Pinnacle) have a legal right to appeal the FL's decision, so to try and prevent us doing so is potentially illegal?

 

Yes, 100% exactly what my thoughts are so it's nice to agree with you Minty ;)

It's essentially the FL trying to rail road Pinnacle into signing an agreement when if they are so sure the points deduction is legal why do they need to do that?
