The FA have no rule prohibiting spying so how can he be punished by them if he has not broken an FA rule? The EFL has a rule but we have already been punished by them for that transgression. The delay in any sort of announcement could well be because the FA cannot punish us for breaking a rule that doesn't exist. 1

It is rule E3.1 - bringing the game into disrepute. I assume they are classing it as 'improper conduct' - acting in a way that harms the reputation of the sport. I assume they can bring this charge against Tonda even though he didn't carry out the specific act as he was the manager in charge when t happened. 1

True .... but how can it be improper if there is no rule against it and it is permissible for all the clubs under the FA's umbrella except for the 72 clubs in the EFL? I appreciate that I am arguing over semantics but that after all is how many of our "learned friends" earn their living. I guess that is why there is currently a delay.

The irony is that the FA themselves could be accused many times of bringing the game into disrepute but the blazers are untouchable. Nevertheless, we just have to live with the fact that Tonda is going to get a good hard kicking from the FA for something that the football world in general thinks is pretty trivial. 3

Yeah, there isn't a written down rule for every transgression that anyone anywhere could ever conceive of. The rules Bringing the game into disrepute/standards/etc cover this and anything like it and lots of things not like it. Basic stuff. 2

Unless the decision has just been communicated to the CEO and Tonda and there's an omerta whilst they appeal. Quite clearly something is up though given the lack of communication this week.

There's not much on any Championship club website or social media this week other than updates on international players and some ticket news as nothing else is going on

I haven't seen any quotes from Tonda at all since before last Thursday and no evidence that he was at the behind closed doors game last Friday. 1

Sounds very much like good old Section 69 of the Army Act 1955 - "Conduct Prejudicial to Good Order and Military Discipline". Shame that one was written out in the Armed Forces Act 2006 and Armed Forces Act 2021 as being not in line with modern principles of law and governance.

Yeah, but, Saints (or Tonda) haven't brought the game in to disrepute. Nobody would have been the wiser of Boro hadn't grassed. So, technically, they're the ones who should be punished.
