Releasing the photo damaged their claims a lot, they initially said he was found hiding in the bushes with a load of high tech equipment including a directional microphone, then they release that and it's clear he was stood in plain sight on a pathway with a camera phone. If he DID have all the equipment, it would make sense that they were suspicious. 2

Looking at their behaviour from the outset of this debacle, I'd bet good money that if they'd had more damning evidence, they would have leaked it through every single media outlet willing to listen.
