My prediction based on absolutely nothing, no training or anything based on reality - I reckon the fine will be bigger (to make an example of us and send a message out to other clubs) but any points deduction will be suspended so that we can't commit the transgression again. I reckon the final goes ahead as planned. My last prediction is that if the final goes ahead as planned, the Boro forums will explode and break the internet. 1 1

It all seems simple to me ... - if Boro didn't want to be spied on they would have made the smallest effort to hide their training pitches from the public. Not doing could be seen as entrapment especially if as has been reported observation is rife in the league - if Boro respected due process they wouldn't have released the photo, Will Salts identity or told everyone what the outcome should be - If Boro/Gibbo had any integrity they wouldn't have been party to a breach of GDPR and this would be the first case like this that they had raised Throw the book at them. The problem the EFL have is that different clubs have different abilities to pay. They should probably go down the GDPR-style route and fine the club X% of turnover in the event of a breach in addition to a set sporting sanction (something like 6 points the following season). I think maybe £2m, but as a few of us have continuously said, it's the proportionality of the punishment to the offence. It opens up far too many legal challenges to throw us out, both through appeal and onwards litigation.

As this is not a court case there is no formal disclosure process here and if such texts did exist neither Southampton or Tonda would voluntarily disclose them. I cannot see why Salt would disclose them either. He’s not being charged with anything - criminally or by way of civil sanction.

Yeah but that would go through the FA as it will be a ban for more than just the EFL. Not to discredit the poster or the source but this isn’t a criminal case, I don’t necessarily believe that we were under any obligation to provide electronic devices to be examined.
